MEMO ON ENVIRONMENTAL IMPACT ASSESSMENT

“Environmental Impact Assessment”; points out the positive and negative effects of the planned projects, measures that can be taken for minimalizing these negative effects so that no harm is done to the environment, evaluation of the place and technology used in the project from this perspective and monitoring of the application of the projects and all the studying under its control. For the projects that are subjects to the “Environmental Impact Assessment Regulation”, which was published in the 29186 numbered 25.11.2014 dated official gazette, “Environmental Impact Assessment Positive” decision or “Environmental Impact Assessment Not Required” decision is mandatory, if not according to the aforesaid regulation, approval, allowance, incentive, building use permit will not be given to the related project, also investment for the projects cannot be initiated and project cannot go out to tender.

Activities started without the “Environmental Impact Assessment Positive” decision and “EIA Not Required” will be indefinitely stopped by ministry of environment and urbanization and local authority respectively. The stopping decision will not be changed until “EIA Positive” or “EIA Not Required” decision, and if these decisions are never taken investor shall reinstate his/her business segment. Otherwise proceedings against the individuals responsible will be initiated according to the 2872 numbered Environmental Law.

After the “EIA Positive” or “EAI Not Required” decision is given in the event of detection of the project owner not following the promised matters in the final EIA report or Project Publicity File, related Ministry/Governorship gives a one-off make-up time of maximum 90 days for the project. If the promised matters are still not fulfilled the investment is stopped. The stopping decision is not removed until the responsible people meet the responsibilities and proceedings according to the 2871 numbered Environmental Law will be initiated against them.

An announcement related to the procedures and principles of the capacity increase and/or plan of expansion for the  projects which are governed under the said regulation and  have “EIA Positive” or “EIA Not Required” decision for them, was published in the 08.06.2016 dated 29736 numbered official gazette.
